HM Treasury | Breathing Space

 The Breathing Space scheme offers vital protections for individuals facing problem debt in England and Wales. These protections include pausing enforcement action, freezing interest and charges, and preventing contact from creditors. Anyone in problem debt who meets the eligibility criteria and accesses debt advice can access a standard breathing space. However, individuals receiving mental health crisis treatment now have an alternative route to access the scheme. If certified by an Approved Mental Health Professional (AMHP), they can initiate a mental health crisis breathing space (MHCBS) with stronger protections. The MHCBS provides individuals with time and space to focus on their treatment without the worry of growing debts or creditor contact. This guidance aims to assist AMHPs and other mental health and care professionals in understanding and facilitating access to the MHCBS, while also encouraging local authorities and organizations to review their related policies and procedures.
